Memorial addressed to the Fourth National Preparatory Investigation Court by the Assembly of the Santa Clara de Uchunya Native Community, within the framework of the criminal investigation for offenses against forests initiated in 2015 against Plantaciones de Pucallpa S.A.C. The Assembly submitted the Memorial for the purpose of directly informing the Judge —in the exercise of its organizational autonomy and self-determination— of the Community's official position regarding the current state of its territory, in light of allegations from third parties invoking its name without the Assembly's authorization. The Community textually declared that it does not maintain current territorial disputes with its neighbors, having concluded on April 8, 2024, the territorial demarcation process in coordination with the Regional Government of Ucayali, in compliance with the second resolutive point of Judgment 22/2022 of the Constitutional Court. It additionally specified that the company Ocho Sur, which currently operates the Tibecocha estate, is a legal entity distinct from Plantaciones de Pucallpa S.A.C., and stated as direct witnesses that such company has not expanded its plantations nor occupied community territory.
